Terms and Conditions.

§ 1 Provider, Scope, Definitions

(1) The provider of the Jonder platform at jonder.jobs is Jonder Deutschland GmbH, Offenbacher Landstraße 405a, 60599 Frankfurt am Main (hereinafter "Jonder").

(2) These terms apply to the use of the platform by professionals (natural persons who create a profile) and by companies (employers and staffing agencies that book a company account). Deviating terms proposed by companies apply only if Jonder agrees to them in writing.

(3) Jonder is a platform for reverse recruiting: professionals create an initially anonymous profile, and companies reach out to them. Jonder does not broker employment relationships, does not owe any placement success, and does not become a party to an employment contract.

§ 2 Conclusion of Contract and Account

(1) By submitting the registration, the user makes an offer to conclude a usage contract. The contract is formed once Jonder activates the account.

(2) The information provided must be true and complete. Login credentials must be kept confidential and may not be passed on. Jonder must be notified immediately of any suspected misuse.

(3) An account may only be used by the person for whom it was created. Companies may invite additional team members and define their permissions; they are liable for such members' use of the account.

§ 3 Services for Professionals

(1) Creating and maintaining a profile, receiving requests, chat and the appointment feature are free of charge for professionals.

(2) The profile is shown to companies in anonymized form. Name, contact details, photo and documents only become visible after explicit release by the professional. Contact rules determine which companies may write to the professional.

(3) Professionals may optionally book paid upgrades as one-time services:

• Highlight – 4,99 €, duration 7 days: Dein Profil wird 7 Tage lang in den Suchergebnissen farbig hervorgehoben.
• Hochpushen – 1,99 €, duration 24 hours: Dein Profil steht 24 Stunden ganz oben in passenden Suchergebnissen.
• Verifikation („blaue Krawatte“) – 9,99 €: Wir prüfen Identität und Abschlüsse. Danach trägt dein Profil das Verifiziert-Abzeichen – deine Anonymität bleibt erhalten.
• Profil-Optimierung durch Jonder – 29 €: Unser Team überarbeitet Profiltext, Skills und Gehaltsrahmen mit dir – für mehr passende Anfragen.
• Professionelles Bewerbungsfoto – 79 €: Fotoshooting mit einem Partnerstudio in deiner Nähe, inkl. 3 bearbeiteter Bilder.
• CV-Maker – 4,99 €: Aus deinem Jonder-Profil wird ein professionell gestalteter Lebenslauf als PDF.

Prices include VAT. Visibility upgrades improve placement in search results; no specific success, number of requests, or hiring outcome is owed.

§ 4 Services for Companies

(1) Companies book a plan billed monthly:

• Basic – 99 € per month, 9999 contact requests per month, 1 user seats
• Premium – 499 € per month, 9999 contact requests per month, 10 user seats
• All inclusive – 899 € per month, 9999 contact requests per month, 25 user seats

All prices for companies are exclusive of statutory VAT. A one-time setup fee of 99 € is charged.

(2) Which features a plan includes is set out in the feature overview at jonder.jobs/preise and is enforced technically.

(3) Equal Rights Seal: Companies may choose the seal. They then permanently search in blind mode, in which name, photo, free-text fields, personality type and dates are hidden, and receive a 50% discount on the monthly fee in return. The discount does not apply to the setup fee. Jonder may revoke the seal if a company circumvents blind mode, for example by asking about name, age, origin or gender before release.

(4) Companies may use profiles exclusively to fill their own positions or positions commissioned by clients. In particular, automated scraping of the platform, passing on profile data to third parties, use for advertising purposes, and combining data with other datasets to re-identify anonymous profiles are prohibited.

§ 5 Prices, Invoices and Payment

(1) Plans are invoiced monthly in advance. Invoices are provided electronically in the app.

(2) Payments are made by bank transfer or via the payment service provider Stripe (card, Apple Pay, Google Pay). The payment provider's terms additionally apply.

(3) In the event of late payment, Jonder may suspend access after prior notice. Statutory default interest remains unaffected.

§ 6 Term and Termination

(1) The usage contract with professionals runs for an indefinite period and may be terminated at any time without notice by deleting the account in the settings. Already-booked upgrades end upon expiry of their term.

(2) Plans for companies run monthly and may be terminated as of the end of the current billing month. Termination is possible in the app or by email to hallo@jonder.jobs.

(3) The right to extraordinary termination for good cause remains unaffected for both parties. For Jonder, good cause exists in particular in the case of serious or repeated violations of § 7.

§ 7 Obligations and Prohibited Content

(1) Users shall not post content that violates applicable law, the rights of third parties, or public policy. In particular, discriminatory job postings within the meaning of the German General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz, AGG), misleading information about the role, salary or employer, chain letters, advertising for other platforms, and malware are prohibited.

(2) A company's first message to a professional must include the role, salary range and a contact person.

(3) Jonder may remove content and suspend accounts if there is a reasonable suspicion of a violation. Affected parties are informed and given the opportunity to respond, unless legal reasons preclude this.

§ 8 Rights to Content

Users grant Jonder a simple, spatially unrestricted right, limited to the term of the contract, to store the content they submit, process it technically, and display it to the respective authorized recipients within the platform. No further use takes place. Rights to the content remain with the users.

§ 9 Availability

Jonder strives to keep the platform available at all times. Maintenance work is announced where possible and scheduled during periods of low demand. During the test phase, restrictions and changes to features may occur; no specific availability is guaranteed during this time.

§ 10 Liability

(1) Jonder's liability is unlimited in cases of intent and gross negligence, in the event of injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantees assumed.

(2) In cases of simple negligence, Jonder is liable only for breach of a material contractual obligation, i.e. one whose fulfillment is essential for the proper performance of the contract and on whose observance the other party may reasonably rely, and liability is limited in amount to the foreseeable damage typical for this type of contract.

(3) Jonder is not liable for the content, statements or conduct of other users. In particular, Jonder does not warrant the accuracy of profile information, job postings or salary information, and does not owe any placement success.

§ 11 Data Protection

(1) Details on the processing of personal data can be found in the Privacy Policy.

(2) Insofar as a company receives data from professionals, it is independently responsible for that data under data protection law. It undertakes to use this data exclusively for the respective hiring process, not to disclose it to third parties, and to delete it once the purpose no longer applies.

(3) Insofar as Jonder processes personal data on behalf of a company, for example notes, message histories and job postings in the company account, the Data Processing Addendum at the end of these terms applies in addition.

§ 12 Changes to These Terms

Jonder may amend these terms with effect for the future if this is necessary due to changes in the legal situation, case law, or features. Changes will be communicated by email at least six weeks before they take effect. If the affected person does not object before the effective date, the changes are deemed accepted; this consequence will be specifically pointed out in the notice. In the event of an objection, either party may terminate the contract as of the effective date.

§ 13 Final Provisions

(1) German law applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the state of their habitual residence.

(2) If the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Frankfurt am Main.

(3) Should any provision be invalid, the remainder of the contract remains valid.

Right of Withdrawal Notice for Consumers

The following notice applies to consumers, i.e. professionals who book upgrades for private purposes. It does not apply to companies.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded. To exercise your right of withdrawal, you must inform us (Jonder Deutschland GmbH, Offenbacher Landstraße 405a, 60599 Frankfurt am Main, email: hallo@jonder.jobs) of your decision by means of a clear statement, for example by email. To meet the withdrawal deadline, it is sufficient to send your notice before the period expires.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and at the latest within fourteen days from the day we receive notice of your withdrawal. We will use the same means of payment for the refund as you used for the original transaction; no fees will be charged for this refund.

Early Expiry

The right of withdrawal expires for a service once we have fully performed it and you expressly agreed, before we began performance, and confirmed that you would lose your right of withdrawal upon full performance. For digital content, it likewise expires once performance has begun. We obtain this consent via a dedicated checkbox when you purchase an upgrade. If, at your request, performance begins during the withdrawal period, you owe a proportionate amount for the service provided up to the point of withdrawal.

Addendum: Data Processing Agreement under Art. 28 GDPR

This addendum applies between the company (controller) and Jonder (processor), insofar as Jonder processes personal data on behalf of the company.

1. Subject Matter and Duration. The subject matter is the operation of the company account on jonder.jobs. Processing continues for as long as the usage contract exists.

2. Nature and Purpose. Storing, displaying, organizing and deleting message histories, notes, appointments, job postings, team and permission management, as well as analytics for the company.

3. Type of Data and Data Subjects. Contact and communication data as well as professional information of professionals that is accessible to the company, and data of the company's employees who use an account.

4. Instructions. Jonder processes the data exclusively on documented instructions from the company. Settings and actions within the company account, as well as instructions given in text form, are deemed instructions. If Jonder considers an instruction unlawful, it will notify the company and may suspend the instruction.

5. Confidentiality. All persons involved in the processing are obliged to maintain confidentiality.

6. Technical and Organizational Measures. Encrypted transmission via HTTPS, passwords stored only as hashes, role-based permissions, access limited to a small number of authorized persons, logging of security-relevant events, daily backups retained for fourteen days, servers in Germany, separation of tenants at the application level.

7. Sub-processors. The company consents to the use of the following sub-processors: STRATO GmbH (hosting, Germany), World4You Internet Services GmbH (email delivery, Austria). Any change or additional sub-processor will be communicated at least four weeks in advance; the company may object and, in that case, terminate the contract extraordinarily.

8. Support. Jonder supports the company with data subject requests, the reporting of data breaches, and data protection impact assessments, to the extent required.

9. Deletion and Return. After the contract ends, the data will be deleted or, upon request, returned, unless a statutory retention obligation applies. Backups expire no later than fourteen days thereafter.

10. Evidence. Jonder demonstrates compliance with these obligations upon request, in particular by providing information in text form. On-site inspections are possible following reasonable advance notice.
